CBS Interactive Software Copyright Notice

As a regular part of our business, our Download Sites display advertisements and product listings from a wide variety of companies. CBS Interactive is not in a position to arbitrate disputes between the owners of intellectual property rights and companies who advertise or list their products on our sites.

For this reason, we encourage copyright owners who believe their rights are being infringed by a company that advertises or lists its products on our site to resolve their disputes directly with that company. We encourage you to seek the advice of legal counsel if you are not sure whether your rights are being infringed or whether you are infringing the rights of someone else.

As a courtesy to owners of copyrighted works, CBS Interactive is willing to perform a limited investigation of reasonable complaints. However, we provide no guarantee that we will remove the allegedly infringing materials from our site.

If you believe that a software product listed on our Download Sites violates your copyrights

If you believe that our Download Sites contain material that violates your copyrights, please send us a notification that contains the information listed below:

  1. A description of the copyrighted work that you claim has been infringed;
  2. A description of where the material that you claim is infringing is located on the site;
  3. An address, a telephone number, and an e-mail address where CBS Interactive can contact you and, if different, an e-mail address where the alleged infringing party, if not CBS Interactive, can contact you;
  4. A statement that you have a good-faith belief that the use is not authorized by the copyright owner, by its agent, or by law;
  5. A statement by you under penalty of perjury that the information in your notice is accurate and that you are the copyright or intellectual property owner or are authorized to act on the owner's behalf;
  6. Your electronic or physical signature.

We will provide the alleged infringing party with your e-mail address. We may request additional information from you before we remove any allegedly infringing material.

If your software has been removed from our Download Sites based on the complaints of another party

We will provide you with notice if we remove your software in response to a complaint that contains the information described above. We will also provide you with the e-mail address of the complaining party so that you may attempt to resolve the issue.

In addition, you may send us a counter notification that contains the information listed below:

  1. A description of the software that has been removed or to which access has been disabled;
  2. A description of where the software that has been removed was located on the site;
  3. An address, a telephone number, and an e-mail address where CBS Interactive can contact you and, if different, an e-mail address where the complaining party, if not CBS Interactive, can contact you;
  4. A statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which the address you gave above is located (or San Francisco County, California if your address is outside of the United States) and that you will accept service of process from the person who provided the original complaint or an agent of that person.
  5. A statement by you under penalty of perjury that you have a good faith that the software was removed or disabled as result of mistake or misidentification of the material to be removed or disabled;
  6. Your electronic or physical signature.

When we receive a counter notification, we will notify the original complaining party that we have received a counter notification. Thereafter, we may re-post the removed software in not less than 10, and no more than 14, business days following the receipt of the counter notification, unless we first receive notice from the original complaining party that they have filed an action seeking a court order to restrain the the alleged infringing party from the engaging in infringing activity.

In all cases, we reserve the right to remove any content pending resolution of a copyright dispute.
